We are Most Played Games Inc. (“We, “Us”, “Our” or “MPG”), with a registered address at: 4th Floor B & P Building, No.843 Arnaiz Avenue, Makati City, Metro Manila, Philippines, is a developer and publisher of mobile game applications on Google Play Store, Apple App Store and Amazon Appstore (our “Games” or “Products”)
You must agree to the following Terms of Service (“Agreement”) prior to using the Services. By using or accessing the Services, it is assumed that you have read and agreed the Agreement. If you do not agree to the Agreement, you are not allowed to use and/or access the Services.
Unless otherwise specified, the Services are free to use or download but may contain features which may allow you to make purchases within the Services.

Installing one of our Games means that you have read and accepted this Agreement and our Privacy Policy (https://atomic-temporary-117672690.wpcomstaging.com/privacy-policy/).
For every installation of our Games to any of your devices a new Agreement will be conlcuded and its terms will apply to your use of our Product. If you do not agree to the Agreement, you are not allowed to use and/or access the Services.
Application stores and platforms may provide their own terms that apply to your relationship with these app stores and platforms.
You represent that you are 13 years or older and if you are not of legal age, you can only install and play our Games on your device, if your legal guardian (may also pertain to your Parents) has reviewed this Agreement and allowed you to install and play our Game subject to these Agreement. Most Played Games Inc. may ask for adequate proof of your age and consent from a parent or guardian at any time.
You represent that you are accessing our Games as a private person. Any commercial use of our Games is not allowed.
2. End-User License Agreement
2.1 License
Subject to the terms of this Agreement, Most Played Games Inc. grants you a non-transferable, non-exclusive, license to (i) for your personal use only, and (ii) copy for the purpose of downloading, installing and executing the number of copies for which you are authorized by the download sites of each Game on a mobile device that you own for your use (the “License”).
2.2 Certain Restrictions
In this Agreement, the rights granted to the user subject to the following restrictions: (i) you can’t license, sell, rent, distribute, or otherwise commercially exploit any Game by MPG; (ii) you can’t modify, translate, adapt, merge, decompile, or reverse engineer any part of our Games except to the extent the foregoing restrictions are expressly prohibited by applicable law; (iii) you shall not access any of our Games in order to create a similar or competitive service or application; (iv) you can’t remove any copyright notices found in our Games. All copyright and other notices on any Game content of MPG must be kept on any copies.
2.3 Changes/Modifications
We reserve the right to modify, suspend, or stop supporting any of our Games without prior notice. You agree that Most Played Games Inc. is not liable to you or any third party for any changes, suspension and the stoppage of support to any of our Games.
2.4 Ownership
Games that you have downloaded from the official app stores of our Games are licensed to you not sold to you. MPG (and its licensors, where applicable) own all the rights and titles, including all related intellectual property rights, in all of our Games. This Agreement is not a sale and does not convey to you any rights of ownership in or related to any Game. The MPG name and logo belong to MPG.
2.5 Ads
During gameplay, ads in the form of (banners, interstitials and video) may appear.
3. Term and Termination
3.1. This User Agreement runs for an indefinite term.
3.2. Either Party may terminate this Agreement at any time by giving 14 days notice. The user may terminate the Agreement by deleting the game from the user’s device.
3.3 Either Party may terminate the User Agreement for cause without giving notice. The grounds for such termination for cause include material breach of these Terms of Service.
4. Third Parties
4.1 Application Stores
You acknowledge and agree that the availability of the Game is dependent on the third party from which you got the Game. You acknowledge that this Agreement is between you and Most Played Games and not with the Application Store from which you acquired the Game. The Application Store is not responsible for the content of the game, (e.g., maintenance, support services, and warranty). You agree to pay all fees charged by the Application Store in connection with the Game (if there are any). You agree to comply with, and your license to use Game is conditioned upon your compliance with, all applicable third-party terms of the agreement (e.g., the Application Store’s terms and policies) when using a Game. You acknowledge that the Application Store (and its subsidiaries) are third-party beneficiaries of this Agreement and will have the right to enforce this Agreement.
5. Disclaimers
5.1 Games are provided as specified on the Application Stores that Most PLayed Games have authorized to sell our Games. Most Played Games makes not warranty that any of our Games: (i) Will meet your requirements; (ii) Will be accurate, reliable, complete, or safe.
6. Limitation on Liability
6.1 In no event shall Most Played Games be liable to you or any third party for any loss of profit, inderect consequences, incidental or special damages relating to this agreement. Use of the game is at your own discretion and risk, and you will be responsible for any damages to your device.
7. Fees
7.1. In-app purchases.
Most Played Games may license to you certain virtual goods to be used within our Games. You may purchase these in-app purchases with real cash or with virtual currency (e.g., “Flippy Coins”, “Tusoks” etc.) you can earn in our Games. These virtual goods are licensed to you on a limited, non-transferable, non-subslicensable and revocable basis. The license is limited to non-commercial use only.
We may modify or remove these virtual goods at any time without any notice. Most Played Games is not liable for any loss of these virtual goods. The prices and availablity of virtual goods can be modified and removed by Most Played Games without any prior notice.
You acknowledge that Most Played Games is not obligated to give a refund for any reason when you delete your game and lose of virtual items due to this.
8. Miscellaneous
8.1. Revisions to this Agreement
This Terms of Use Agreement is subject to revisions and we will notify you about these changes posting about the changes on our website (www.mostplayedgames.co). Continued use of our games will indicate that you agree to the changes to this Agreement.
